You have a legal duty of care to manage your asbestos
Legislation regarding asbestos is very clear. Brought out in 2006 (Control of Asbestos Regulation 2006) it means all non domestic property owners have a legal duty of care to manage asbestos. You are required to find out if there is asbestos, assess the risk, prepare a plan to manage it and then act upon it with regular reviews. You are also required to provide an information register to anyone who is likely to work on or disturb the asbestos.
Failure to have this information and a management plan in place could result in prosecution by the HSE

The Duty Holder must:
- Take reasonable steps to determine the location and nature of asbestos and presumed asbestos materials present
- Keep and regularly update a register of the location, condition, maintenance and removal of all asbestos materials.
- Manage all aspects of asbestos materials that are to remain in place by means of a management plan.
- Inform anyone who is likely to disturb asbestos containing material about its location and condition.

- Identify its location
- Through laboratory testing identify its type
- Ascertain its condition
